By Entering into any contract with us as a Client, you agree to be legally bound by these Terms and Conditions found below. Please go through these terms, if you do not agree with our Terms and Conditions, we suggest you not to use our service.  Logo Design Gear may change or revise any terms and conditions at any time, you must go through our terms and conditions page periodically to make yourself updated. In these Terms and Conditions, LogoDesignGear.com,  services related to it, and all text, images, photographs, designs,  data and other content included in it from time to time (including, without limitation, the selection, coordination and arrangement of such content) are referred to as the "Service". LogoDesignGear.com is owned and operated by, LogoDesignGear, India based company.
If you break these Terms and Conditions, LogoDesignGear.com reserves the right to prevent your future use of this website, cancel your order, and/or take appropriate legal action and remedies available against you.

Technical Details of Logo Design:
Color : We create the logo using RGB/CMYK colors.
Format: We provide the following formats .ai, .eps, . pdf, .psd, .tiff, .jpeg, .gif, .png, .bmp, in 300 dpi (for print use) and 72 dpi (for web use).
Fonts included in the design will be supplied(However in certain cases, such as font based logo etc. we will not be able to supply the font).
We do not create logo designs for the following companies,
Porn site, Adult product site, terrorism site, Firearms, Ammunition, High Capacity Magazines, Tasers, Stun Guns, Air Guns, Paint Guns, Weapons, Swords and Knives etc.

Payment:
Choose LogoDesignGear.com logo package.
Pre-payment for all services is required unless a different payment plan is agreed to, in writing, by both parties.
We accept all credit cards, debit cards and paypal.
All prices listed on Logo Design Gear are in USD.
Logo Design Gear will email the client after the transactions is successfully done. If payment is not made, we reserve the right to cancel the order without letting you know.
We suggest the expected delivery time is very accurate, it is not, however, guaranteed that the delivery time will be always being met. No claim in any form, monetary or non-monetary, can be made against Logo Design Gear (including its parent, subsidiaries, affiliates, officers, owners, directors, attorneys, agents and employees) if the deadline date is not reached in time.

Money back policy:
Logo Design Gear provides a 100% satisfaction guarantee. We guarantee that we will continue to work on your project until you are satisfied. If in any case you don’t like our custom logo design concepts, you can contact your Project Manager before receiving revisions or redraws for a refund (Money Back Policy is not applicable for standard logo design package).In order to ensure that we stay in business, we will retain a design fee, which is $99.
 If you don’t contact us for money back and choose to continue with redraw and revision your money back policy will be void and we will continue with the logo design process until you are satisfied.
Refunds do not apply if you have purchased the Standard Logo Design Package.
Refunds do not apply to projects that have requested any revisions and/or requested for redraw.
Refunds do not apply if you have approved a design.
Refunds do not apply to printed material including business cards, letterhead and envelopes .
Refunds do not apply if the company we are designing a logo for closes, changes their name, or their activity.
Refunds do not apply if you have obtained the logo design from a 3rd party.

PLEASE NOTE:
In the case where we do not hear back from a client for more than 4 weeks during the production stage, we reserve the right to close the project without any notification. A fee of $75 USD will be applicable to re-open the project and continue work on the project.

Without limiting the foregoing, you agree not to transmit, distribute, post, communicate or store information or other material on, to or through the Web Site that:
    

Customer care rights
We aim to reply to all emails within 24 hours. However, you are fully aware that by placing an order on our site does not guarantee that any of your emails will be answered within 24 hours. Your order guarantees you the right to receive any email reply within 72 hours. You are fully aware of your customer care rights set out here and therefore no chargeback claims can be awarded in the event of an unanswered email in any circumstances until the 72 hour period has fully elapsed.

Eligibility Require.
As a Client, you must be at least 18 years of age, agree to these Terms and Conditions. As a Client, you represent and warrant that you meet these eligibility requirements, that the information you include is complete and accurate. Logo Design Gear may accept or reject your project in its sole discretion. The Service is not directed to children.

Completing Your Creative Brief
We require our clients to complete our internal creative brief (either online, or emailed) in full in order to meet your design requirements. If we do not receive a complete creative brief, we will notify you and will wait to proceed until the creative brief is completed in full.
However if we listen back from you within 1 weeks time with complete creative brief we will eventually close your project and refund money.

Ownership
All final artwork become the property of the Client, having unlimited and royalty-free use of the artwork upon payment of all fees. Logo Design Gear retains the right to display the artwork in their portfolio and advertising materials unless we have received a written request to be removed or denied from inclusion in our portfolio. The client is free to register his/her logo and/or artwork created by our firm under his/her name or trademark.

DELIVERY AND ACCEPTANCE
Upon completion of its products and/or services in accordance with the terms and conditions set forth in your Contract, Logo Design Gear shall deliver your product and/or service to a temporary location designated by Logo Design Gear for your review. Logo Design Gear will notify you via e-mail of such completion and delivery, and the manner in which you may access the temporary location for purposes of reviewing your product and/or service. Or we may directly email you the files for review. After you received the file, you must confirm us. If you take more than 4 weeks, we reserve the right to close the project without any notification.

DISCLAIMER OF WARRANTIES
YOU HEREBY EXPRESSLY ACKNOWLEDGE AND AGREE THAT THE INFORMATION, SERVICES, TEXT, GRAPHICS, LOGOS OR OTHER ITEMS PROVIDED OR MADE AVAILABLE BY Logo Design Gear ARE PROVIDED “AS IS” WITHOUT ANY EXPRESS OR IMPLIED WARRANTY OF ANY KIND.

TO THE FULLEST EXTENT PERMITTED BY LAW, Logo Design Gear HEREBY DISCLAIMS ALL IMPLIED WARRANTIES OF ANY KIND, INCLUDING WITHOUT LIMITATION WARRANTIES OF MERCHANTABILITY, SUITABILITY, INFRINGEMENT OF INTELLECTUAL PROPERTY RIGHTS, OR FITNESS FOR A PARTICULAR PURPOSE. Logo Design Gear MAKES NO WARRANTY THAT ITS PRODUCTS OR SERVICES WILL BE PROVIDED IN A TIMELY AND SECURE MANNER, OR WITHOUT ERRORS OR DEFECTS, OR THAT ITS PRODUCTS OR SERVICES WILL NOT INFRINGE ON THE INTELLECTUAL PROPERTY OR PROPRIETARY RIGHTS OF ANY THIRD PARTY. Logo Design Gear DOES NOT WARRANT THAT THE RESULTS OBTAINED FROM YOUR USE OF THE PRODUCTS OR SERVICES PROVIDED BY Logo Design Gear WILL MEET YOUR EXPECTATIONS.

Access and Interference
You agree that you will not use any robot, spider or other automatic device, process or means to access the Site. Nor shall you use any manual process to monitor or copy our web pages or the content contained thereon or for any other unauthorized purpose without our prior expressed written permission. You agree that you will not use any device, software or routine that interferes with the proper working of the Site nor shall you attempt to interfere with the proper working of the Site. You agree that you will not take any action that imposes an unreasonable or disproportionately large load on our infrastructure. You agree that you will not copy, reproduce, alter, modify, create derivative works, or publicly display any content in any way, form, detail or design from the Site without the prior expressed written permission of Logo Design Gear and the third party, as applicable. We reserve the right to take legal action if this is found to be the case.   

Indemnity
You agree to indemnify and hold Logo Design Gear (and its parent, subsidiaries, affiliates, officers, owners, directors, attorneys, agents and employees), harmless against any loss, claim or demand, liability, costs and expenses (including reasonable attorneys' fees), made by any user or third party due to or arising out of your actions or omissions on this site or your violation of any law or the rights of a third party.
    
    
No Agency
You and Logo Design Gear are independent contractors, and no agency, partnership, joint venture, employee-employer or franchiser-franchisee relationship is intended or created by this Agreement.
Dispute Resolution
Disputes between you and Logo Design Gear our services may be reported to info@logodesigngear.com, with email subject : Dispute Resolution. Our goal is to provide you with a neutral and cost effective means of resolving the dispute quickly. We strongly encourage you to first contact us directly to seek a resolution, before resorting to other alternatives.
We encourage you to report all disputes between users to your local law enforcement body.

General
If any provision of this User Agreement is held to be invalid or unenforceable, such provision shall be struck out and the remaining provisions shall be enforceable. You agree that Logo Design Gear may automatically assign this User Agreement and all incorporated agreements in our sole discretion, to a third party in the event of a merger or acquisition or any other event. Headings are for reference purposes only and in no way define, limit, construe or describe the scope or extent of such section. Our failure to act with respect to a breach by you or others does not waive our right to act with respect to subsequent or similar breaches.    
This User Agreement sets forth the entire understanding and agreement between us with respect to its subject matter. No oral explanation or oral information given by any party shall alter the interpretation of this User Agreement.
